Probate and Probate Litigation

Probate

Courts are usually required to oversee the administration of someone's property and assets and debts after they die.  Even if the person has a will, or if they do not, the process overseeing this action is typically called Probate.  The court will appoint a personal representative and then follow the statutes or rules to administer and pay debts and dispose of assets.

Probate Litigation

There are many times when family members disagree with each other or with the court or with a will about the disposition of assets and payment of debts.  If someone is disinherited or if there is injustice in the proposed plan to distribute assets, then attorneys will be involved.
